The Johnsonville Sausage “Create Your Own ____VILLE” Contest (the “Contest Promotion”) is open only to legal residents of the fifty (50) United States (including District of Columbia) who are at least thirteen (13) years old at the time of entry. Void in Guam, Puerto Rico, the U.S. Virgin Islands, and other U.S. territories and possessions and where prohibited by law. Employees of Johnsonville Sausage, LLC., Matrixx Productions, Inc. or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution, provisioning of prizing or advertising/distribution of the Promotion and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Administrator’s decisions, which are final and binding in all matters related to the Contest Promotion. The Contest Promotion begins on May 3, 2009 at 12:00 a.m. Eastern Time (“ET”) and ends on July 31, 2009 at 11:59 p.m. ET (the “Promotion Period”). Sponsor’s computer is the official time keeping device for this Contest Promotion.
Photography, imagery and text used in a submission must be original or in the public domain.
Administrator shall have the right to disqualify any entries that they deem to be obscene, vulgar, sexually explicit, lewd, derogatory, inappropriate, or otherwise not in good taste, as determined in their sole discretion. Administrator may withdraw a submission at any time without notice.
There are two ways to enter the Contest Promotion:

In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
By mail: To enter by mail, please hand-print your full name, address (including city, state and zip code), daytime telephone number (including area code), date of birth, gender and email address (if available) on a 3 ½” x 5” card. Include a photograph, a caption, specify the category (Grillmeister, Big Game, Top of the Morning, Vacation or Get Crazy) and the Johnsonville product image to be used in the submission. Mail these materials in an envelope with proper postage affixed to: Johnsonville Sausage Contest c/o Matrixx Productions Inc., 3122 Santa Monica Blvd. Ste 201, Santa Monica, CA 90404. Mail in entries must be postmarked by July 31, 2009 and received by August 7, 2009 to be eligible. The Sponsor and Administrator are not responsible for printing errors or for stolen, lost, late, illegible, inaccurate, incomplete, damaged, garbled, delayed, postage due or misdirected entries. All mail-in materials become the property of Sponsor and none will be returned. Proof of mailing does not constitute proof of delivery.
Sponsor reserves the right to contact entrants of this Contest Promotion.
There are five (5) categories for submissions in the Contest Promotion.
To determine the potential winners, submissions in the Grillmeister, Big Game, Top of the Morning, Vacation and Get Crazy categories will be judged and ranked by Sponsor and Administrator using the following criteria:
All entries in all categories shall be eligible for Viewers Choice which be determined in order of the highest number of votes.
In the event of any ties in ranking or total votes, Sponsor and Administrator shall determine the potential winners in its sole discretion.
First Place Winners: On or about August 10, 2009, one (1) First Place Winner will be selected from all eligible entries in each category and will receive a First Place Prize (ARV $2,500). There are a total of five (5) categories plus Viewers Choice and there will be a total of six (6) First Place Prizes awarded (Total ARV $15,000).
Second Place Winners: On or about August 10, 2009, one (1) Second Place Winner will be selected from all eligible entries in each category and will receive a Second Place Prize (ARV $80). There are a total of five (5) categories plus Viewers Choice and there will be a total of six (6) Second Place Prizes awarded (Total ARV $480).
Third Place Winners: On or about August 10, 2009, six (6) Third Place Winners will be selected from all eligible entries in each category and will receive a Third Place Prize (ARV $30). There are a total of five (5) categories plus Viewers Choice and there will be a total of six (6) Third Place Prizes awarded (Total ARV $180).
Grand Prize Winner: On or about August 10, 2009, one (1) Grand Prize winner will be selected from the six (6) First Place Winners and will additionally receive the Grand Prize (ARV $7,500).
Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected.
The First Place Winners and the Grand Prize Winner will be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release (collectively, “Prize Claim Documents”). If a winner is not of legal age of majority in his or her state of residence (a “minor”), at Sponsor’s option, the applicable prize either will be awarded in the name of the parent or legal guardian of the minor winner, or the parent or legal guardian of the minor winner will be required to ratify and sign the Prize Claim Documents. If any potential winner (or such minor winner’s parent or legal guardian) fails or refuses to sign and return all Prize Claim Documents within five (5) days of prize notification, such winner may be disqualified and an alternate winner may be selected.
Sponsor or Administrator shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within five (5) days of the first notification attempt, or if the prize notification is returned as undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected.
First Place Prize: SIX (6) FIRST PLACE PRIZES: Each First Place Winner (one per each of the five categories plus Viewers Choice winner) will receive a prize package (the “First Place Prize”) consisting of a grill, grill utensils, heat lamp or fire pit, propane gas coupons, cooler, hammock, outdoor recreation products gift card, Johnsonville hat, Johnsonville t-shirt, Johnsonville product coupons, a cash amount or other prizes as determined by Sponsor in its sole discretion. Sponsor may substitute any prize in its sole discretion. The Approximate Retail Value (“ARV”) of each First Place Prize is $2,500.00. The total ARV of the six First Place prizes is $15,000.00
Second Place Prize: SIX (6) SECOND PLACE PRIZES: Each Second Place Winner (one per each of the five categories plus Viewers Choice winner) will receive a prize package (the “Second Place Prize”) consisting of a tabletop grill, Johnsonville hat, Johnsonville t-shirt, Johnsonville product coupons, or other prizes as determined by Sponsor in its sole discretion. The Approximate Retail Value (“ARV”) of each Second Place Prize is $80.00. The total ARV of the six Second Place prizes is $480.00
Third Place Prize: SIX (6) THIRD PLACE PRIZES: Each Third Place Winner (one per each of the five categories plus Viewers Choice winner) will receive a prize package (the “Third Place Prize”) consisting Johnsonville hat, Johnsonville t-shirt, or other prize as determined by Sponsor in its sole discretion, The Approximate Retail Value (“ARV”) of each Third Place Prize is $30.00. The total ARV of the six Third Place prizes is $180.00.
Grand Prize: ONE (1) GRAND PRIZE: Chosen from among the six First Place winners, one Grand Prize winner will receive a prize package (the “Grand Prize”) consisting of a cash amount, additional grilling prizes, outdoor recreation gift cards or other prizes as determined by Sponsor in its sole discretion. The Approximate Retail Value (“ARV”) of the Grand Prize is $7,500.00. The Grand Prize Winner shall also retain their First Place Prize. The First Place Prize ARV of $2,500.00 combined with the Grand Prize ARV of $7,500.00 totals ARV $10,000.00
Prizes are non-transferable and no substitution will be made except as provided herein at Sponsor sole discretion. Sponsor reserves the right to substitute any listed prize for one of equal or greater value for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Entrant acknowledges and agrees that the materials submitted shall be owned solely by Sponsor. All such submissions and materials (The “Works”) shall constitute works made for hire within the meaning of the United States Copyright Act. To the extent any work is deemed not to be a work made for hire, entrant hereby deems to have assigned to Sponsor the copyright in and to such work. Entrant shall execute any and all additional documents proposed by Sponsor to effectuate and confirm Sponsor sole and exclusive ownership of all copyrights in and to all such work, and entrant hereby irrevocably appoints Sponsor as attorney-in-fact to execute any and all such documents if entrant fails to return the same to Sponsor, duly executed, within five days following submission of the particular document by Sponsor to entrant. Consistent with Sponsor ownership of such works, entrant acknowledges and agrees Sponsor can use the Works for all purposes deemed appropriate by Sponsor, such purposes to include, without limitation, to access and view the Works and to reproduce, modify, adapt, display, email and otherwise distribute information, including for commercial purposes such as online, television or commercial advertising without having to pay any compensation for any such use.
Entrant agrees that Sponsor shall have the right, where permitted by law, to use entrant’s name, voice, likeness, photograph, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
Administrator reserves the right to cancel, suspend and/or modify the Contest Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Administrator’s reasonable control impairs the integrity or proper functioning of the Contest Promotion, as determined by Administrator in its sole discretion. Administrator reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes Promotion; (4) technical or human error which may occur in the administration of the Sweepstakes Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes Promotion or receipt or use or misuse of any prize. The Johnsonville Big Taste Grill Sweepstakes (the "Promotion") is open only to legal residents of the forty-eight (48) Contiguous United States (including District of Columbia) who are at least thirteen (13) years old at the time of entry. Each entrant will receive one (1) entry into the text-to-win prize drawing upon successful submission of the text message. Limit: One (1) entry per person via texting during the Promotion Period. Instant Win: Ninety-eight (98) Instant Winners will randomly be selected during the Promotion Period. Upon successful transmission of their first text message, entrant may be randomly chosen as an instant winner. Each Instant Winner will receive a regular prize.
Grand Prize Drawing: On or about August 7, 2009 the Grand Prize winner will be randomly selected from all eligible entries received during the Promotion Period.
The potential winners will be notified by text message and a phone call. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason.
